Terms of Service

1. Acceptance of Terms

By accessing or using Realform ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform. These Terms apply to all users of the Platform, including agencies, property managers, and form signatories.

Realform is operated by Dassit Pty Ltd (ACN 677 140 233) with its registered address in Victoria, Australia.

2. Service Description

Realform provides a digital platform for Australian real estate agencies to:

• Create, send, and manage real estate authority forms and other agency documents;
• Collect legally-binding electronic signatures;
• Maintain audit trails and certificates of authenticity; and
• Track commissions and fees associated with property management.

The Platform is not a legal compliance service. While we provide VIC-compliant form templates, you remain solely responsible for ensuring that all documents, disclosures, and procedures comply with applicable laws and regulations in your jurisdiction.

3. User Accounts & Responsibilities

Account Creation. You must register for an account to use the Platform. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

OTP Security. Realform uses one-time passwords (OTPs) sent via email for identity verification. You are solely responsible for maintaining the confidentiality of the email account associated with your Realform account. You must notify us immediately of any unauthorised use of your account.

Accurate Information. You agree that all information you submit through the Platform — including agency details, property addresses, vendor information, and financial figures — is accurate and complete to the best of your knowledge.

Account Responsibility. You are responsible for all activity that occurs under your account, whether or not authorised by you. Realform is not liable for any loss or damage arising from your failure to comply with this section.

4. Plans & Billing

Realform offers the following plans:

• Free — Limited form sends per month with basic features.
• Pro — A$39/month. Higher send limits, advanced templates, and full audit trail export.
• Enterprise — A$79/month. Unlimited sends, team management, priority support, and custom form templates.

Manual Assignment. Plans are currently assigned manually by Realform. When you upgrade, we will enable the corresponding features on your account within a reasonable timeframe.

Payment Terms. Payment is due in advance on a monthly basis. All fees are in Australian dollars (A$) and include GST where applicable. Late payments may result in suspension of access to the Platform.

Changes to Plans. We reserve the right to change our pricing and plan structure at any time. We will provide at least 30 days' notice of any price change affecting your current plan.

5. Acceptable Use

You agree not to use the Platform to:

• Send, sign, or process documents that are illegal, fraudulent, or violate any applicable law;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Upload or transmit any viruses, malware, or harmful code;
• Interfere with or disrupt the integrity or performance of the Platform;
• Attempt to gain unauthorised access to any Realform systems or user accounts;
• Use the Platform in a manner that exceeds reasonable usage limits as determined by Realform.

Realform reserves the right to review and remove any content that violates these Terms or that we reasonably believe is inappropriate.

6. Intellectual Property

Platform IP. The Platform, including its software, design, logos, branding, and underlying technology, is the exclusive property of Realform (Dassit Pty Ltd) and is protected by Australian and international intellectual property laws. No licence or right to use Realform's trademarks or trade names is granted by these Terms.

Your Data. You retain all intellectual property rights in the documents, data, and information you upload or create through the Platform ("Your Data"). Realform claims no ownership over Your Data. You grant Realform a limited licence to access, store, and process Your Data as necessary to provide the Service.

7. Limitation of Liability

To the maximum extent permitted by Australian law, Realform (including its officers, employees, and agents) shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages;
• Any loss of profits, revenue, data, or business opportunity;
• Any damages arising from your use or inability to use the Platform;
• Any errors or omissions in documents generated using the Platform.

Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total amount paid by you to Realform in the 12 months preceding the claim, or A$100, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

8. Termination

By You. You may terminate your account at any time by contacting support@realform.com.au. Upon termination, your access to the Platform will be removed.

By Realform. We may suspend or terminate your account immediately without notice if:

• You breach any provision of these Terms;
• Your use of the Platform poses a security or legal risk;
• Payment is overdue by more than 30 days; or
• Required to do so by law.

Effect of Termination. Upon termination, your right to use the Platform ceases immediately. We will retain Your Data for a period of 90 days after termination, after which it will be permanently deleted unless required by law to retain it.

9. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising out of or relating to these Terms or the Platform shall be resolved exclusively in the courts of Victoria, Australia.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (to the address associated with your account) and/or by posting a notice on the Platform. Your continued use of the Platform after the changes take effect constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. The "Last updated" date at the top of this page indicates when these Terms were last revised.
